We are Luminous Connections, LLC, doing business as Avery Studio ("Company," "we," "us," "our"). We operate the website www.shannonaverybriggs.com, as well as any other related products and services that refer or link to these legal terms.

Legal Agreement

01 Our Services

Avery Studio provides custom web design, brand strategy, and digital presence services for small businesses and service providers. Services are delivered through the GoHighLevel platform. The information provided through our Services is not intended for distribution to any person or entity in any jurisdiction where such distribution would be contrary to law or regulation.

02 Intellectual Property Rights

We are the owner of all intellectual property rights in our Services, including all source code, website designs, audio, video, text, photographs, and graphics, as well as the trademarks, service marks, and logos contained therein. Our content is protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express prior written permission.

03 User Representations

By using the Services, you represent and warrant that: (1) you have the legal capacity to agree to these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.

04 Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:

Systematically retrieve data or content from the Services to create a database or directory without written permission
Trick, defraud, or mislead us or other users
Circumvent or interfere with security-related features of the Services
Disparage, tarnish, or otherwise harm us or the Services
Use any information obtained from the Services to harass, abuse, or harm another person
Use the Services in a manner inconsistent with any applicable laws or regulations
Upload or transmit viruses or any other disruptive material
Attempt to impersonate another user or person
Use the Services to compete with us or for any unauthorized commercial purpose

05 Services And Payment

Avery Studio offers three service packages: Launch Ready (starting at $1,500), Premium Brand (starting at $3,500), and Full Digital Presence (starting at $7,500). Final pricing is determined based on the scope of your project as discussed during your consultation.

Payment plans are available for all packages. Details are discussed and agreed upon prior to project commencement.

All service packages cover design, strategy, and setup only. Domain registration and GoHighLevel platform subscription costs are separate and are the responsibility of the client.

06 Intellectual Property Of Client Deliverables

Upon receipt of full payment, the client owns all final deliverables created specifically for their project, including custom design files and written copy. Avery Studio retains the right to display completed work in its portfolio unless otherwise agreed in writing.

07 Term And Termination

These Legal Terms remain in full force while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason at our sole discretion. If we terminate or suspend your access for any reason, you are prohibited from registering or accessing the Services under any other name.

08 Modifications And Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We will not be liable for any modification, suspension, or discontinuance of the Services.

09 Governing Law

These Legal Terms are governed by the laws of the State of Washington. You irrevocably consent that the courts of Washington shall have exclusive jurisdiction to resolve any dispute arising in connection with these Legal Terms.

10 Dispute Resolution

Informal Negotiations: To expedite resolution and control costs, the parties agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration.

Binding Arbitration: If informal negotiations fail, disputes shall be resolved through binding arbitration in Washington State. The language of proceedings shall be English.

Restrictions: Arbitration shall be limited to the dispute between the parties individually. No class action arbitration is permitted.

11 Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12 Limitations Of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE LESSER OF THE AMOUNT PAID BY YOU FOR THE APPLICABLE SERVICE OR $500.

13 Indemnification

You agree to defend, indemnify, and hold harmless Luminous Connections, LLC and its officers, agents, and employees from any loss, damage, liability, or claim made by any third party due to: (1) your use of the Services; (2) breach of these Legal Terms; or (3) any harmful act toward another user of the Services.

14 User Data

We will maintain certain data you transmit to the Services for the purpose of managing performance. You are solely responsible for all data you transmit. We shall have no liability for any loss or corruption of such data.

15 Electronic Communications

Visiting the Services, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements and notices provided electronically satisfy any legal requirement for written communication.

16 Miscellaneous

These Legal Terms constitute the entire agreement between you and us. If any provision is deemed unlawful or unenforceable, it shall be severed without affecting the remaining provisions. There is no joint venture, partnership, or employment relationship created between you and us as a result of these Legal Terms.
